I see that on the ndc.org site that my bankruptcy is marked as complete and awaiting discharge.
Although I have indeed completed the Proof of Claim payments as prepared by Donna Wilkinson of BBDFTE, representing PHH, I have not received a release of lien on the property in question, or indeed any acknowledgment whatsoever that these payments have been received by the creditor and applied to any account. I have paid through your offices not only the amount due on principal, as agreed by all parties, but also substantial fraudulent service charges, fraudulent costs of public sale, fraudulent costs of affidavits and filings, that I continue to dispute through separate action.
I have not received any statement from the creditor concerning disposition or return of escrow funds that are continued in possession of PHH, including refund of prorated insurance premium which was credited to my account last year, in 2013. I have inquired without response.
My accounting of payments on principal over the twelve years of the fifteen year mortgage period, the last year of payments managed by your office, has not been reconciled with the mortgagee, and I have received no communication in response to my inquiries to their New Jersey domicile.
I notified the mortgagor in January that since they had not released lien, they were to continue making property tax payment for 2012 due on 31 January, and again received no response. I paid the property tax, along with 8% penalty on 10 March 2014.
I do not wish this bankruptcy discharged until all parties, myself and PHH Mortgage, have indicated their mutual satisfaction and all monies due are reconciled.
